Is it legal for a civilian to wear an American flag patch?

Origin of the American Flag Patch

How an Army Personnel should wear the American Flag Patch

Headquarters, Department of the Army (HQDA) has a policy that authorizes all soldiers to wear the full color of the American flag patch with a size of 2 inches by 3 inches on the utility uniform. The patch is to be worn on the Army Combat Uniform (ACU) and its fire retardant variant, the Flame-Resistant Army Combat Uniform (FRACU). The policy states that the patch should be sewn about half inches below the right shoulder seam of these uniforms. If the shoulder sleeve insignia-former wartime service (SSI-FWTS) is worn on the right shoulder, the flag patch should be placed 1/8 inch below the SSI-FWTS.
